1. Introduction and acceptance
These Terms and Conditions (“Terms”) are a legal agreement between you and [Company legal name], trading as BestHosting BD (“BestHosting BD”, “we”, “us”), a business registered in Bangladesh under Trade License [number]. They apply to every service we provide, including web hosting, BDIX hosting, Singapore hosting, VPS, dedicated servers, domains, SSL certificates, email and related support.
By creating an account, placing an order, paying an invoice or using any service, you confirm that you have read and accept these Terms, our Privacy Policy and any policy referred to here. If you do not agree, do not use our services.
2. Definitions
- “Services” means all products and services we provide to you.
- “Client Area” means your online account for orders, invoices, domains and tickets.
- “Content” means any files, data, websites, emails, software or material stored, sent or published using the Services.
- “Billing Cycle” means the period you pay for, such as monthly or yearly.
3. Eligibility and accurate information
You must be at least 18 years old, or the age of majority where you live, and legally able to enter a contract. If you order on behalf of a company or organization, you confirm you are authorized to bind it.
You must give us complete and accurate contact, billing and identity details and keep them up to date. We may ask for verification such as a copy of your NID, passport or trade license before activating or continuing a service. We may refuse, suspend or cancel any order that we believe is fraudulent, high risk or based on false information.
4. Your account and security
You are responsible for everything done through your Client Area, control panel, FTP, SSH and email accounts, and for keeping passwords and access keys secure. Use strong passwords and enable two-factor authentication where available.
Tell us immediately if you suspect unauthorized access. We are not liable for loss caused by your failure to protect your login details. For security reasons we may ask you to verify your identity before making account changes, and we may refuse requests we cannot verify.
5. Orders, setup and right to refuse service
Services are activated after payment is received and any required verification is complete. Setup times shown on our website are estimates.
We reserve the right to refuse or cancel any order at our discretion, including where the intended use would break these Terms or the law, before the service is activated. If we refuse an order after you have paid, we refund the amount paid for that order.
6. Billing and payment
All prices are in Bangladeshi Taka (BDT) unless stated otherwise. VAT and other government charges are added as required by Bangladeshi law and National Board of Revenue rules.
Invoices are generated before each renewal date and are due on or before the due date shown. Accepted payment methods may include bKash, Nagad, Rocket, SSLCommerz, Visa, Mastercard, American Express, bank transfer and other methods shown at checkout. Payment gateway fees, where charged, are non-refundable.
You are responsible for making sure payments reach us in full. A payment is only treated as received when it is credited to our account.
7. Auto renewal and cancellation
Services renew automatically for the same Billing Cycle unless you cancel before the renewal date. Renewals are charged at our current renewal price for that service, which is shown on our website and in your Client Area.
You can request cancellation from your Client Area, either immediately or at the end of the Billing Cycle. Cancellation requests by email or chat may not be accepted for security reasons. Data on cancelled services is deleted and cannot be recovered, so download your backups first.
8. Late payment, suspension and deletion
- If an invoice is unpaid more than 10 days after its due date, a late fee of 10% of the invoice amount (minimum ৳200) may be added.
- Services may be suspended if an invoice remains unpaid more than 15 days after its due date. A reconnection fee may apply.
- Hosting accounts unpaid more than 45 days after the due date may be terminated, and all data permanently deleted, without further notice.
- Domains that are not renewed expire according to registry rules and may be lost, released or charged a redemption fee.
-
9. Refund policy
We want you to be happy with our service. If you are not, you may request a refund within the periods below by opening a billing ticket from your Client Area.
- Yearly and multi-year shared, web, BDIX and Singapore hosting plans: refund within 30 days of the first purchase.
- Monthly hosting plans: refund within 7 days of the first purchase.
- Refunds apply to the first purchase of a service only, not to renewals, upgrades or repeat orders.
The following are non-refundable: domain registrations, renewals and transfers; VPS and dedicated servers; SSL certificates; software licenses; setup, migration and installation fees; managed services; add-ons; and any service terminated for breach of these Terms.
If your hosting plan included a free domain, the regular price of that domain is deducted from your refund and the domain remains yours. Approved refunds are paid to the original payment method, or to a bKash or bank account in your name, within [10] working days, less any non-refundable gateway fees.
10. Chargebacks and payment disputes
Please contact our billing team before disputing a payment with your bank, card issuer or mobile financial service. Most problems can be solved quickly.
If you file a chargeback or dispute without contacting us first, we may suspend all related services until it is resolved, charge an administrative fee of [৳1,000], and refer unpaid amounts for collection. Fraudulent payment disputes may be reported to the relevant authorities.
11. Free domain conditions
A free domain is included only with eligible yearly hosting plans, for the first year, and for the extensions listed at the time of purchase. The domain is registered in your name. From the second year, domain renewal is charged at the normal price. Free domains cannot be exchanged for cash or credit.
12. Domain registration terms
Domain registrations are subject to the rules of the relevant registry: Bangladesh Telecommunications Company Limited (BTCL) for .bd domains, and ICANN and the relevant registry for international domains. By registering a domain, you also agree to those rules and to our Domain Registration Agreement.
- You are responsible for choosing a name that does not infringe anyone’s trademark or other rights.
- Registrant details must be accurate. False details can lead to suspension or cancellation by the registry.
- Bangladeshi .bd domains require supporting documents and approval by BTCL. Registration is not guaranteed until BTCL approves it, and BTCL fees are non-refundable once submitted.
- International domains may be locked against transfer for 60 days after registration, transfer or change of registrant, in line with ICANN policy.
- Expired domains may enter grace and redemption periods with additional fees set by the registry.
13. Freedom of expression and lawful content
We believe in an open internet. We host personal blogs, news portals, opinion sites and organizations of every kind, and we do not remove lawful content simply because someone disagrees with it.
We only restrict content when it breaks these Terms or our Acceptable Use rules, when it is unlawful under the laws of the People’s Republic of Bangladesh, when we receive a valid order from a competent court or authority, or when it puts our network, other customers or the public at risk. Where it is lawful and safe, we will tell you about a complaint and give you a chance to respond before acting.
14. Acceptable use and prohibited content
You may not use the Services, directly or through your users, to store, publish, send or link to content or activity that is illegal or harmful, including:
- Anything illegal under the laws of Bangladesh, including offences under the Cyber Security Ordinance 2025, the Information and Communication Technology Act 2006 and the Bangladesh Telecommunication Act 2001.
- Online gambling, betting or casino services.
- Child sexual abuse material of any kind. We report it to the authorities immediately.
- Phishing, fraud, scams, fake shops, pyramid schemes or impersonation of banks, mobile financial services or government bodies.
- Malware, viruses, botnets, hacking or cracking tools, and attacks on other systems including DDoS, brute force and port scanning.
- Spam or unsolicited bulk email or SMS, and mailing lists without verified consent.
- Pirated software, nulled themes or plugins, warez, and content that infringes copyright or trademarks.
- Content that incites violence, terrorism or hatred against people based on religion, ethnicity, gender or other protected characteristics.
- Cryptocurrency mining, public proxies or VPNs, IRC bots, torrent trackers, and file-sharing, backup or archive storage on shared hosting.
- Personal data collected or used without a lawful basis or consent.
15. Resource usage and fair use
Shared hosting plans run on shared servers. To keep performance fair for everyone, each account must stay within reasonable limits. Plans described as “unmetered” or “unlimited” are for normal website use, not unlimited use of server resources.
- CPU, RAM, entry processes and I/O are limited per account as shown in cPanel.
- Accounts may use up to [250,000] inodes (files and folders).
- Outgoing email is limited to [300] messages per hour per account.
- Disk space is for website files, databases and email only, not for backups, archives or media storage.
If an account repeatedly exceeds these limits or harms server stability, we may throttle it, ask you to optimize or upgrade, or suspend it if there is an immediate risk.
16. Backups and your data
You are responsible for keeping your own up-to-date backups of all Content. Any backups we take are a courtesy, may not be complete or current, and are kept for a limited time. We do not guarantee that any backup can be restored.
We are not responsible for loss of data caused by you, your users, software you install, hardware or software failure, security incidents, or actions we take under these Terms. Please make a full backup before upgrades, migrations or support requests.
17. Security and emergency action
To protect our network, customers and the public, we may, without prior notice, suspend, isolate, reset, rebuild, block ports, remove malicious files or disable any service or Content that is hacked, infected, under attack, sending spam or putting other users at risk.
We will tell you what happened and what you need to do as soon as reasonably possible. We are not liable for loss caused by emergency action taken in good faith. Our services are not certified as a PCI DSS compliant environment, so do not store full card numbers on shared hosting.
18. VPS, dedicated servers and root access
VPS and dedicated servers are unmanaged unless your plan clearly says managed. You are fully responsible for the operating system, software, updates, security, firewall and backups of your server. We provide the hardware, network and power on an “as is” basis.
We may access a server only to perform support you request, to investigate abuse, to protect the network or when required by law.
19. Reseller accounts
Resellers are responsible for their own customers and for making sure those customers follow these Terms. We provide support to the reseller, not to the reseller’s customers. A violation by a reseller’s customer is treated as a violation by the reseller.
20. Suspension and termination
We may suspend or terminate any service immediately, with or without notice, if you breach these Terms, fail to pay, provide false information, abuse our staff, or if we are required to do so by law or a competent authority.
Services terminated for breach of these Terms are not refunded. You may terminate a service at any time by cancelling it in your Client Area. Sections that by their nature should survive termination, such as payment, liability and indemnity, will continue to apply.
21. Complaints, legal requests and law enforcement
We comply with valid orders and requests from courts, the Bangladesh Telecommunication Regulatory Commission (BTRC), law enforcement agencies and other competent authorities under the laws of the People’s Republic of Bangladesh. Where a request is lawful, we may preserve or disclose account information and Content, or remove or disable access to Content.
Where we are allowed to, we will notify you of a request that concerns your account. We may challenge requests that appear unlawful, too broad or not properly authorized.
Copyright and trademark complaints should be sent to legal@besthosting.com.bd with enough detail to identify the material and the rights owner. We may remove infringing material and forward the complaint to the customer, who may respond with a counter-notice.
22. Intellectual property and use of your logo
You keep all rights to your Content. You give us a limited license to store, copy and transmit it only as needed to provide the Services.
Our software, website, designs and trademarks remain our property. Unless you tell us in writing that you prefer otherwise, we may list your business name or logo as a customer on our website and marketing materials.
23. Privacy and data protection
We handle personal data as described in our Privacy Policy. For personal data that you collect and store on our Services, you are the data controller and responsible for having a lawful basis, consent where required and your own privacy policy. We act only as your service provider for that data.
24. Service level and uptime
We aim for 99.9% monthly network uptime on shared hosting. If a verified outage caused by us brings uptime below this target, you may request a service credit within 7 days of the incident. Credits are applied to future invoices, are capped at [one month’s fee] for the affected service, and are your only remedy for downtime.
Scheduled maintenance, emergency security work, problems caused by you or your software, attacks, third-party networks and force majeure events are excluded.
25. Price changes
We may change our prices at any time. Price changes do not affect a Billing Cycle you have already paid for. New prices apply from your next renewal, and we will give at least [30] days’ notice by email for any increase to an existing service.
26. Disclaimer of warranties
Except as required by law, the Services are provided “as is” and “as available”. We do not guarantee that the Services will be uninterrupted, error-free or completely secure, or that they will meet every one of your requirements.
27. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, business, data or reputation, even if we were told it was possible.
Our total liability for all claims relating to the Services is limited to the amount you paid us for the affected service in the three (3) months before the event that caused the claim. Nothing in these Terms limits liability that cannot be limited under the laws of Bangladesh.
28. Indemnification
You agree to defend and compensate BestHosting BD, its owners, staff and partners against any claims, losses, fines, penalties and legal costs arising from your Content, your use of the Services, your breach of these Terms or your violation of any law or third-party right.
29. Force majeure
We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, floods, cyclones, fire, power failures, submarine cable cuts, BDIX or upstream network outages, internet shutdowns or restrictions ordered by the government, strikes, hartals, war, civil unrest, epidemics and large-scale cyber attacks.
30. Governing law and jurisdiction
These Terms are governed by the laws of the People’s Republic of Bangladesh. Subject to section 31, the courts of Dhaka, Bangladesh have exclusive jurisdiction over any dispute arising from these Terms or the Services. If you are a consumer outside Bangladesh, you keep any mandatory protections given to you by the law of your country.
31. Dispute resolution
If you have a complaint, contact our support team first and give us 30 days to try to resolve it. If we cannot agree, either party may propose mediation, or arbitration in Dhaka under the Arbitration Act 2001 if both parties agree in writing, before going to court.
To the extent permitted by law, disputes are handled individually and not as part of a class or representative action.
32. Your consumer rights
Nothing in these Terms removes any right you have under the Consumer Rights Protection Act 2009 or any other law that cannot be excluded by agreement.
33. General terms
- Assignment: you may not transfer your account or these Terms without our written consent. We may transfer them as part of a merger, sale or reorganization.
- Severability: if any part of these Terms is found invalid, the rest remains in force.
- Entire agreement: these Terms, together with the policies they refer to and your order, are the whole agreement between us.
- No waiver: if we do not enforce a right immediately, we can still enforce it later.
- Language: if we provide these Terms in Bangla and there is any difference, the English version applies.
34. Changes to these Terms
We may update these Terms from time to time. The date at the top shows the latest version. We will give reasonable notice of material changes by email or in your Client Area. Continuing to use the Services after a change takes effect means you accept the updated Terms.
